7. Shipping and Delivery
Delivery dates are estimates only and are not guaranteed.

Christmas1967 shall not be responsible for delays caused by:

• Supply chain disruptions.
• Weather events.
• Government actions.
• Labour disputes.
• Circumstances outside our reasonable control.

Ownership of products passes to the customer only after full payment has been received.

Risk of loss or damage passes in accordance with applicable law.

For business customers, risk passes upon delivery of the products to the delivery location specified by the customer.

For consumers, risk passes when the products are physically received by the consumer or by a person designated by the consumer to receive the products.

Christmas1967 shall not be liable for delays in delivery that are outside its reasonable control, nor for any indirect or consequential losses arising from such delays.

8. Inspection Upon Receipt
Customers must inspect all products immediately upon delivery.

Any claim relating to:

• Damage
• Defects
• Missing items
• Incorrect items

must be reported to Christmas1967 within seven (7) days of delivery.

Failure to provide notice within this period may be deemed acceptance of the products, subject to any mandatory consumer rights that cannot legally be excluded.

9. Returns and Refunds
Returns and refunds are governed by our Returns Policy and applicable law.
The following products may not be eligible for return:

• Bespoke products
• Custom-made products
• Personalised products
• Special-order products
• Clearance products
• Final-sale products
• Products that have been installed, used, altered, damaged, or modified after delivery

Nothing in these Terms & Conditions limits statutory consumer rights that cannot legally be excluded.

10. Commercial and Professional Use
Many Christmas1967 products are intended for use in Consumer environments.
The customer is solely responsible for:

• Product suitability
• Engineering review
• Structural requirements
• Installation methods
• Regulatory compliance
• Safety assessments
• Ongoing maintenance
• Inspection schedules

Professional installation may be required for certain products.

Christmas1967 does not provide engineering, architectural, structural, electrical, fire-safety, or regulatory approval services unless expressly agreed in writing.

11. Product Use and Assumption of Risk
All products are purchased, transported, stored, assembled, installed, maintained, displayed, and used entirely at the customer's own risk. The customer is solely responsible for determining whether a product is suitable for its intended application, environment, location, installation, or project. Christmas1967 makes no representation or warranty that any product is suitable for any specific application unless expressly confirmed in writing. Without limitation, Christmas1967 shall not be responsible for any loss, damage, injury, expense, claim, or liability arising from:

• Installation or assembly.
• Transportation or storage.
• Improper handling.
• Alteration or modification.
• Maintenance activities.
• Electrical integration or connection.
• Environmental conditions.
• Wear and tear.
• Misuse.
• Unintended use.
• Acts or omissions of customers, contractors, installers, venue operators, consultants, or other third parties.

The foregoing examples are illustrative only and do not limit the scope of the liability exclusions contained within these Terms & Conditions.

12. Disclaimer of Warranties
To the fullest extent permitted by applicable law, all products, services, content, and information are provided on an "as is" and "as available" basis.

Christmas1967 expressly disclaims all warranties, representations, and conditions, whether express, implied, statutory, or otherwise, including but not limited to:

• Merchantability.
• Fitness for a particular purpose.
• Non-infringement.

14. Maximum Liability
To the fullest extent permitted by applicable law, the total aggregate liability of Christmas1967 arising out of or relating to any claim, order, transaction, product, or series of related events shall not exceed the amount actually paid by the customer for the specific product giving rise to the claim.

Where multiple products are involved, liability shall be limited to the purchase price of the affected product only.

Under no circumstances shall Christmas1967 be liable for the value of an entire project, installation, event, commercial operation, or any related indirect or consequential losses.

15. Force Majeure
Christmas1967 shall not be liable for any delay, disruption, interruption, or failure to perform resulting from circumstances beyond its reasonable control, including:

• Flood.
• Pandemic.
• Epidemic.
• War.
• Terrorism.
• Civil unrest.
